A nationally known stand-up comedian from West Hollywood, California, was acquitted of charges that he sexually assaulted a Mall of America comedy club server last July.

Adam S. Richmond, 39, was charged with third-degree criminal sexual conduct and fourth-degree criminal sexual conduct after being arrested at his Bloomington hotel room on July 29, 2013. A server at Rick Bronson's Comedy Club had said Richmond tried to grope her and became aggressive.

Arresting officers say Richmond told them "maybe I was a little aggressive." His blood alcohol content at the time was listed at 0.17, according to a criminal complaint.

On Tuesday, Judge Daniel H. Mabley ruled that because both parties were intoxicated and there were a lot of inconsistencies in their stories, Richmond could not be found guilty, Laughspin reports.

Richmond asked for a bench trial instead of a trial by jury, the Star Tribune notes.

The woman said Richmond, who has appeared on national television shows including "Last Comic Standing," hit on her while performing as the club's headliner last July. Although she told him she wasn't interested, she allowed him to stop by her Bloomington home for drinks, FOX 9 reported.

The complaint says Richmond made suggestive comments and tried grabbing at the woman while at the home, and became aggressive toward her when the woman’s roommates went to bed.

After punching Richmond and kneeing him in the groin and fleeing the home, the woman was followed by Richmond outside – where he knocked her down and felt the woman’s genitals over her clothing, the complaint said. The complaint also notes that the woman alleged Richmond attempted to have her perform a sex act on him. The woman eventually made her way back into her home, where she called 911.
