A 27-year-old man was drunk and driving more than 100 mph moments before he crashed into a vehicle in Rochester, according to charges filed Thursday in Olmsted County District Court.
The deadly drunk-driving crash happened Dec. 19, 2020 near the intersection of 18th Avenue Northwest and Crimson Ridge Drive around 9 p.m. A criminal complaint accuses Matthew R. Shaver, of Rochester, of speeding southbound on 18th Ave. NW in a Jeep Wrangler at 107 mph just two seconds before he rear-ended a Toyota Corolla.
Shaver was going 92 mph, in a 45 mph zone, a tenth of a second before impact.
A female passenger in the vehicle that was struck died at the scene, while the driver was transported to a hospital with injuries.
Shaver, who was ejected and critically injured in the crash, had a blood-alcohol content of 0.155, which is nearly twice the legal limit in Minnesota.
The woman killed was identified as 24-year-old Joharmi Rubio. Her husband, 27-year-old Luis Rubio Lunar, survived.
Shaver, now 28 years old, has been charged with four counts of criminal vehicular homicide, including for driving in a negligent manner, under the influence of alcohol and above the 0.08 legal limit.
