The victim says it happened shortly after he'd threatened to kill her.

A Savage father is accused of raping the mother of his child, recording the assault and then sharing it on Facebook.

Markeith Spencer, 28, is alleged to have carried out the assault on the woman as she slept in her child's bed on July 2.

The victim had taken out a restraining order against Spencer in March, but despite this they had a confrontation outside a Buffalo Wild Wings on July 2, during which Spencer threatened to kill her and pulled out a gun.

The gun turned out to be a BB gun, but the victim says she believes that Spencer sexually assaulted her that same night as she slept.

She told police that Spencer had recorded a video of him penetrating her, which he then posted on his Facebook page, and at the end of the video he can be seen mouthing "Oops." Police say both the victim and Spencer are clearly identifiable.

July 2 was Spencer's birthday, and the victim told officers he'd forced her to let him stay at her home that night, which is why she slept in her children's room.

Although the video was deleted, investigators were given access to his Facebook history and found that on July 7 he had uploaded a video called "Whitey's Birthday Video," with the description stating: "Don't ever stunt on me hoe."

Spencer's Facebook name is "Whitey Spencer."

Another woman, with whom Spencer also has a child and whom also has a restraining order out against him, told police he had admitted posting the video on Facebook and bragged about it.

He allegedly said: "Yeah I did that to that b----, that b---- can stop stuntin'."

He also allegedly said: "I don't give a f--- if she was sleeping."

When initially interviewed by police, Spencer claimed he hadn't seen the video and didn't know where it came from. He then said it was over a year old and the video was consensual, claiming the victim takes Adderrall and "nods off."

He then said someone must have hacked his Facebook account.

Spencer has been charged with 4th degree criminal sexual conduct, nonconsensual dissemination of private images, breach of a restraining order and terroristic threats.
