Eagan Mayor Michael Maguire has been charged with DWI after getting his SUV stuck in a snowbank earlier this month.

Maguire, 52, got stuck near the intersection of Dakota Path and Shadow Creek Curve in Eagan around 8 p.m. on Jan. 11, according to a criminal complaint. Officers arrived at the scene and found Maguire in the still-running vehicle.

Police documented the smell of alcohol and Maguire displayed slowed and slurred speech. He then failed a field-sobriety test and refused to finish all of the roadsides challenges involved in the test, the complaint says.

A preliminary breath test revealed a blood-alcohol content of .19, more than twice the legal driving limit of .08.

Maguire is in his fourth term as mayor of Eagan, having previously served on the city council from 2003-07.

The case is being prosecuted by the Hastings City Attorney's Office, so as to avoid there being a conflict of interest.
