Prosecutors in Beltrami County have filed criminal charges against the man at the helm of a boat involved in a deadly Fourth of July accident on Cass Lake.

Matthew Allen Kinghorn admitted to investigators that he had been drinking rum and cokes when his boat hit a wave, sending him and two passengers into the water, KARE 11 reports.

One of the passengers, 50-year-old Brenda Larson, died.

The station says Kinghorn's blood-alcohol level was at 0.125 percent – the legal limit for drivers in Minnesota is .08.

He has been charged with criminal vehicular homicide.

Kinghorn and his 3-year-old son – who was reportedly the only one on the boat wearing a life vest – were rescued by fishermen; however, Larson was not so lucky.

Larson was found in the water, unresponsive and not breathing, and was later pronounced dead at a hospital.

Larson, an Eden Prairie resident, was a coach for Team Foxjet, a local swimming group that attracts about 400 children per year.

According to the Star Tribune, the criminal complaint says her death was consistent with drowning.

The paper says she had accompanied Kinghorn, his wife and son on the boat trip; the wife was the only person not thrown from the craft.

Kinghorn's next court date has not yet been set.
