Mille Lacs Co. attorney won't face charges for underage drinking party

The prosecutor who reviewed the case involving several underage kids drinking on a property owned by Mille Lacs County Attorney Jan Jude in late May determined that there isn't enough evidence to press charges.

The Mille Lacs Messenger says Andover City Attorney Scott Baumgartner was assigned the case by the Minnesota County Attorneys Association.

The investigation was launched by authorities when 17-year-old Bailey Hamilton ended up in the hospital after downing a half bottle of vodka at a graduation party near Milaca, Minn.

After reviewing statements from 19 people at the party, not one of them said that Jude or her husband, Russ Jude, a Mille Lacs Tribal Police officer, provided any of the alcohol, City Pages reports.

Jude maintains that she had no knowledge of underage consumption taking place at the party held for her daughter, but even if she did, City Pages points out, it wouldn't be a crime because Mille Lacs County doesn't have a social host ordinance.

Baumgartner said, "the only thing I could have seen as misconduct would be an obligation to move forward with charges of underage consumption." But even that, he told City Pages, would be a stretch.
