Judge says 2 Minn. men will be tried in Bismarck attempted murder

A North Dakota judge says there is enough evidence against two Minnesota men to try them on attempted murder charges in connection with the beating of a Bismarck man in June.

The Associated Press reports 33 year-old Jose Nelson Osorio and 19-year-old Kelvin Rolando Osorio Oviedo pleaded not guilty to the charges Friday, following a preliminary hearing.

Osorio and Oviedo are accused of stabbing and beating Rafael Angel Diaz Zayas, 25, on June 11 or 12 at a Bismarck apartment. Zayas, of Bismarck, was taken to a hospital on the morning of June 12 with life-threatening injuries, the Bismarck Tribune reported at the time.

Testimony from a police detective says Osorio acknowledged to beating and stabbing what he thought to be a shadow and that Oviedo also used dumb bells in the attack. Osorio and Oviedo were later arrested in Douglas County, Minn.
