No felony charges against mother in St. Louis Park pond crash

KARE 11 and MPR News report a mother whose car slid off a highway ramp and into a St. Louis Park holding pond, killing two of the five children in the vehicle, will not be charged with a felony, Hennepin County Attorney Mike Freeman announced Wednesday.

"This is a horrible, horrible tragedy and there is nothing the criminal justice system can or should do about it," Freeman said in a news release.

Investigators reconstructed the November accident, conducted tests and interviews and determined that Marion Guerrido was not speeding, did not have drugs or alcohol in her system and was not on her cell phone at the time of the incident, KARE 11 reports.

Instead, investigators say she overcorrected and spun out. An initial investigation had found the road was wet.

Alarious Guerrido, 7, and Zenavia Rennie, 5, died in the crash. Three other children who were in the car are still recovering. Guerrido was the mother of Alarious and two of the surviving children, one of which she had with her boyfriend JR Rennie. Two of Rennie's children from another relationship were also in the car, including Zenavia.

Guerrido was driving with only a learner's permit and no licensed driver in the car, which the law requires, but it is not yet clear if she will be cited for those violations, KARE reports.

JR Rennie spoke about the family's struggles in a January KSTP interview.
