State Democrats sue to get replacement candidate for Gauthier on ballot
The state's Democratic Party asked the Supreme Court Friday to remove exiting Duluth Rep. Kerry Gauthier's name from the ballot and replace it with Erik Simonson's name, the Star Tribune reports.
The DFL is asking the court to overturn a previous ruling by the St. Louis County Auditor.
Gauthier withdrew his name for re-election after he admitted to a sexual encounter with a 17-year-old boy at Duluth rest stop in August. State GOP leaders earlier called for his dismissal prior to a special state legislative session for flood relief, but the matter was never taken up.
Days later, DFL leaders urged Gauthier to abandon his bid for re-election. The first-term Representative announced Aug. 22 that he would not run again.
Earlier this month, Simonson, an assistant fire chief with the City of Duluth, won the DFL bid to replace Gauthier in the District 7B House race earlier this month.
