A man accused of stabbing a former University of Minnesota Duluth star running back is no longer facing charges.

A judge on Tuesday dismissed a second-degree assault charge against 23-year-old Xavier Davis, who prosecutors said punched and stabbed Austin Sikorski in an August street fight, according to FOX 21.

The defense disagreed, and so did the presiding judge – he said "there is not enough evidence to suggest that Mr. Davis was the one who did it," reports the Duluth News Tribune. The judge added "any number of people might have done it."

He granted the defense's request to dismiss the case.

The incident stems from a bar fight that apparently started in the Flame nightclub in downtown Duluth. The Tribune notes Sikorski "could not remember any particular person stabbing him."

The attack left the running back with an abdominal injury that required surgery, but he was back on the field a month later.
