2 junior hockey players plead guilty to making sex tape with teen

Two junior hockey players will serve time in jail after pleading guilty to to making a sex tape with a 15-year-old girl in a motel room in Moorhead, and then sending the tape to other people.

Thomas Carey, of Moorhead, and Brandon Smith, of California, both now 20, pleaded guilty Tuesday to three felony charges, DL-Online reports. They were charged in 2014 with using a minor in a sexual performance, possession of child pornography and distributing pornography, all felonies.

On Tuesday, Carey told the court in February 2014 he was staying at the Moorhead Days Inn while in town for a hockey game when he had sex with the 15-year-old girl while Smith filmed, Valley News Live says. Smith said he then sent the video to Carey and the victim.

Carey and Smith's plea agreement calls for the them to spend 45 days in jail, followed by 10 years of probation, reports note.

If they don't violate their probation – which includes having no contact with the victim – and pay a $2,000 fine, they won't have to register as sex offenders, WDAY says. The men also have to undergo a sex-offender evaluation. Carey has already enrolled in sex offender counseling, Valley News Live says.

They were allowed to begin serving their jail sentences Tuesday, KFGO reports. They will be formally sentenced in January.

The plea agreement comes after months of legal motions, including defense attorneys requesting the charges against the men be dropped, citing the victim's character. That request was denied by the judge.

When the incident happened, both men were on the roster for the Lincoln Stars, a United States Hockey League team.
