Three suspects in the death of a University of Minnesota Duluth student are now facing first-degree murder charges.

A grand jury has indicted Deandre Demetrius Davenport, Noah Duane Baker, and Noah Anthony Charles King, on two counts first-degree murder each in the death of 22-year-old William Andrew Grahek.

They were previously charged with second-degree murder.

These upgraded murder charges mean if they're convicted, they'll be sentenced to life in prison. (A conviction of first-degree murder carries a mandatory life sentence in Minnesota. That's why a grand jury is used to decide those charges, not just the county attorney.)

Grahek – who was the son of a St. Paul police sergeant – was shot twice in his Duluth home on Feb. 14.

Five people were arrested in connection to Grahek's death, with investigators saying Davenport, King and Baker entered Grahek's home with a gun in an attempt to steal cash and drugs.

The two other people who were arrested weren't accused of going into Grahek's home, so they weren't part of the indictment.

They are charged in connection to the case, though. Xavier Alfred Haywood was charged with aiding an offender to avoid arrest, while Tara Rai Baker – who's accused of being the getaway driver – was charged with aiding and abetting intentional second-degree murder and attempted first-degree aggravated robbery.

Davenport, Noah Baker and King are scheduled to be arraigned on the new charges Tuesday, the St. Louis County Attorney's Office told GoMN.
