Motorcyclist who hit 4-year-old birthday boy to be released Tuesday

The motorcyclist who struck and seriously injured a 4-year-old boy as he sped recklessly through St. Paul's Frogtown neighborhood has been sentenced to time served. Ernest Jonas, 25, of St. Paul, who fled the scene of the May 19 accident, was to be released from jail Tuesday. Relatives were upset. "He don't care. He's just happy to be getting out of jail," the boy's mother, Marcia Scroggins, said.

The motorcyclist who struck and seriously injured a 4-year-old boy as he sped recklessly through St. Paul's Frogtown neighborhood has been sentenced to time served, the Pioneer Press reports. Ernest Jonas, 25, of St. Paul, who fled the scene of the May 19 accident, was to be released from jail Tuesday.

Prosecutors had asked for a 365-day sentence, KARE 11 reports.

Relatives were frustrated and angry.

Marcella Scroggins-Phillips, Tyrell’s grandmother, is devastated by Ernest’s release, WCCO reports.

“It just breaks my heart that that guy can go home tomorrow,” she told the station.

The criminal complaint against Ernest Jonas says neighbors had yelled at him to slow down. But witnesses say he was doing wheelies on his motorcycle and traveling about 60 mph when he struck four-year-old Tyrell Baymon. The boy remains hospitalized in critical condition.

He told a judge they could not help falling in love. The girl, who has since turned 18, said, "I want everyone to know that this (prosecution) was not my choice. I was not victimized."
