Officer Yanez will go to trial in Philando Castile case

Yanez's attorneys filed a motion to try to get the case dismissed.

The case against Jeronimo Yanez will go to trial.

Ramsey County District Court Judge William Leary III on Wednesday denied a motion from Yanez's attorneys to dismiss the charges against him.

Yanez was charged with manslaughter in connection to 32-year-old Philando Castile’s death during a traffic stop on July 6, 2016. Ramsey County Attorney John Choi said at the time "no reasonable officer who knew, saw or heard what officer Yanez did at the time would have used deadly force under these circumstances."

But his attorneys filed a motion to get the case against Yanez dismissedarguing Yanez did everything correctly when he pulled Castile over, and his actions were justified because Castile reached for his gun.

Both sides gave oral arguments in court Wednesday morning, during which Jeffrey Paulsen, a federal prosecutor who is assisting the Ramsey County Attorney's Office on the case, told the judge the case should go to trial because the defense and prosecution disagree on some major points, like whether Castile reached for a gun and whether Yanez saw the weapon, MPR News reports.

Judge Leary wrote in Wednesday's five-page ruling that Castile's behavior does not exonerate Yanez "because a victim's unreasonable conduct is never an absolute defense to a criminal charge" and evidence presented by the prosecution makes it "fair and reasonable" to allow the case go to trial.

A plea hearing for Yanez is scheduled for Feb. 27 at 9 a.m.
