Secret settlement gets Boston Scientific sued


A patent-licensing firm is suing Boston Scientific Corporation over a "secret settlement" with St. Jude Medical.

According to a report in the Minneapolis/St. Paul Business Journal Mirowski Family Ventures says the settlement cost them hundreds of millions of dollars and they are seeking $570 million in damages.

The family claims that Boston Scientific and Little Canada-based St. Jude quietly settled six lawsuits, in a deal that called for St. Jude to drop claims against Boston Scientific.

Mirowski says that settlement violated a contract that required Boston Scientific to consult with them on patent-infringement litigation.

Law360 reports that Mirowski claims Boston Scientific and Guidant owed them $235 million in damages from a Delaware lawsuit that the company dismissed against St. Jude and another $250 million in damages that they could've received from an Indiana infringement suit that was also dismissed as a result of the settlement.

Law360 was unable to reach Boston Scientific for comment.
