Security guard who fatally shot man outside club won't face charges


A security guard who shot and killed a man while being attacked by a group outside of Stargate Nightclub in May will not be charged with a crime, FOX 9 reports.

The Maplewood Police Department said the 28-year-old guard was being attacked by a group – including Chou Yang, a 20-year-old from St. Paul – around 1 a.m. outside the Maplewood club.

According to police video evidence and witness accounts, the group chased the guard from the club’s entrance to the parking lot. The security officer then fell to the ground and was swarmed and assaulted.

The security officer was armed and fired his gun, striking Chang. He was taken to Regions Hospital in critical condition, but later died, police said.

On Monday, the Ramsey County Attorney's Office said the guard will not be charged in the incident, the Pioneer Press reports. The office said it was "reasonable" for the guard to fear for his health and life while being attacked, therefore his use of force "was authorized."

According to the Star Tribune, the altercation began when the security officer asked the man to leave the club.

The security guard was described as being “fully cooperative” with investigators.

He works for JBM Patrol & Protection Services, which is based in Edina but is not being identified due to threats made against him since the incident, FOX 9 says.
