Woman remains in ICU with severe injuries after freak accident at MN pizza joint

An Oregon woman is in intensive care with severe injuries from a freak accident that saw a tree fall on her as she ate at a Minnesota pizza joint.

Micki Scott was dining with her husband, Dan, and daughter, Dawnette, on the patio at Punch Pizza in Wayzata on May 6 when they heard a cracking noise. They watched in horror as a tree from The Big Woods Preserve adjacent to the restaurant snapped and fell onto the patio.

According to a GoFundMe page, the tree landed on Smith and required about 20 people to lift it off her so she could get out. Her injuries are horrific, including five pelvic fractures, one back fracture, a head wound, seven broken ribs, a punctured lung and multiple other injuries to her mid-section.

Micki and Dan Scott were visiting Minnesota to celebrate their daughter's 50th birthday, but now they're raising money just so they can make the journey home.

At this stage they're not sure how long Scott will be in intensive care, though they note that she's "healing" and "showing signs of 'waking up.'"

They say she might be transferred to a care facility for a few weeks, but they need to raise money for her trip home as her insurance doesn't cover the cost of a medical transport flight, which is expected to cost in the region of $18,000-$25,000.

Wayzata investigating if it's responsible

Meanwhile the City of Wayzata is looking into its own insurance coverage to see whether it will be held responsible for the incident.

KARE 11 spoke to city manager Jeffrey Dahl, who says they have submitted a claim to its insurance company but if it's found there's no negligence in the city's upkeep of the forest, it'll be considered an "act of God" and the city won't be liable.

He did say however that an arborist who surveyed the tree after the incident said it looked like the tree was diseased, and the city removed several more near the restaurant that were deemed a possible threat to the public.

The City of Wayzata sent a statement to GoMN, saying it also worked with Punch Pizza to clean up the site.

"The city continues to wish the injured woman well and hopes for a full recovery," the statement added.
