Two of the men are accused of using a law enforcement shield during the insurrection.
He was one of two suspects arrested in Minnesota and charged Friday.
Thirty-five Republicans broke with their party and voted in favor of the legislation.
Jonah Westbury, 26, was arrested Friday morning.
The 39-year-old is facing charges 'related to criminal acts' at the Capitol on Jan. 6.
He's believed to be the first Minnesotan arrested in connection to the riot.
People from at least 42 states have been charged.
This comes amid ongoing threats to state Capitols across the country.
Charges say he shared photos on social media of him inside the Capitol on Jan. 6 and commented on a post saying he's wanted by the FBI.
"Those who made threats of violence at the rally in St. Paul should be investigated and held accountable," the letter states.
